Capital Development Authority issue SOP for prevention of misplacement of files from Law Wing, CDA

Islamabad: November 10, 2017: Capital Development Authority has issued SOP for prevention of misplacement of files from Law Wing, CDA. The action has been taken to do away with complaints regarding misplacement of files from Law Wing. Law Wing of Capital Development Authority is passing through consistent up-gradation and information since Member Administration Mr. Muhammad Yasir Pirzada took charge of his office.

Member Administration Mr. Muhammad Yasir Pirzada has said that it had been noticed with great concern that various important files mostly of Estate Management-I, Estate Management-II have been lost during handling of court cases, commits preparation or opinion work etc. At some time these files were referred to concerned Advocate/ Counsel by Law Wing or concerned Directorate directly where these remain unattended for a considerable period of time. These file containing important variable record and should be kept in proper custody. In order to effectively stop breach of confidentiality and to ensure safe custody of official files Standing Operating Procedure has been approved after due deliberations.

As per new SOP, no file regarding legal opinion shall be marked to any of the CDA Counsels either by Law Directorate or by any of the concerned Directorate, except Legal Advisor and Additional legal Advisors. No file should remain unattended with the diary clerk for more than two days otherwise responsibility will be fixed upon diary clerk. In case, views from the concerned counsel conducting the case are required, the same have to be routed through the DDG (LAW).

In order to seek status / latest position of court cases, the concerned section of law wing will issue letter to the CDA Counsel who will intimate on his/her Letter Head about the position of the case within two days, failing which action will be taken not only against the concerned section but the CDA Counsel.

The files will sent to Mr. Saeed Khan, In-charge of Parokar (IOP), (or his successor in office) Civil Court  Section, F-8, CDA, he will call the CDA Counsel in CDA office, F-8 for vetting the written statements and will return the file within two days. In case of delay he will bring it to the knowledge of Dy. Director (Law/Labour) and Dy. Director General (LAW) otherwise he will be responsible.

For vetting of parawise comments for High Court cases, the file will b marked to Mr. shahzad Admin Officer (Lit-I) (or his successor in office), who will call the Advocate in CDA office for vetting the comments and get finalized within two days. In case of delay, he will bring in to the knowledge of Dy. Director (LAW-II) and DDG (LAW) otherwise he will be responsible. 

The Receipt & Issuance Section, Law wing will keep vigilant and monitor daily dak/files and report to Assistant Director (Law/Admin) who will be bound to report to DDG (LAW) on weekly basis for timely and effective receipt and issuance of files forwarded to Admin officer (Lit-I), High court Section and Incharge of Parokar (IOP) , Civil Court Section. In case of any unnecessary delay the R&I Section, Law Wing will bring in the knowledge of Assistant Director (LAW/admin) and DDG (LAW) or otherwise responsibility will be fixed.
